Terms of Service

These Terms of Service ("Terms") govern your access to and use of the study materials, practice examinations, and related services ("Services") provided by NPPE Preparation, a sole proprietorship operating at https://www.nppepreparation.com("we," "us," or "our"). By accessing or purchasing access to our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Description of Services

NPPE Preparation provides an independent online study guide and practice examination resource designed to assist candidates preparing for the National Professional Practice Examination (NPPE). Our Services include access to written study materials covering all six NPPE Blueprint topic areas, two full-length 100-question practice examinations with answer explanations, and an interactive examination simulator with topic-by-topic scoring. NPPE Preparation is an independent educational resource and is not affiliated with, endorsed by, sponsored by, or produced by Engineers Canada, Geoscientists Canada, the Association of Professional Engineers and Geoscientists of Alberta (APEGA), or any other provincial or territorial engineering or geoscience regulatory body. NPPE™ is a trademark of its respective owners.

2. Individual Use License

Upon purchase, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial exam preparation purposes only. This license is strictly individual. You may not: (a) share your account credentials or access link with any other person; (b) allow any other person to access the Services using your account; (c) reproduce, copy, distribute, republish, upload, post, transmit, or otherwise share any portion of our content in any form or by any means; (d) sell, sublicense, or commercially exploit any part of our Services or content; (e) use our content to create derivative works, competing products, or training materials; (f) remove or obscure any copyright, watermark, or proprietary notice. Violation of this section will result in immediate account termination without refund and may result in legal action.

3. Account Registration and Security

To access our Services, you must create an account through our authentication provider. You agree to provide accurate, complete, and current information during registration. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at administration@nppepreparation.com if you suspect unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials. You may not create multiple accounts or use another person's account.

4. Access Period and Expiry

Your access to the Services is granted from the date of purchase until 11:59 PM Mountain Time on the exam date you selected at the time of purchase. After this date, access is automatically revoked. We do not offer extensions under any circumstances, including if you reschedule your exam, defer your exam attempt, or do not write your exam on the selected date. We recommend purchasing access for the specific exam session you intend to write. If your exam date changes after purchase, you may purchase a new session at the then-current price. Unused access time does not carry forward.

5. Pricing and Payment

All prices are displayed and charged in Canadian dollars (CAD). Pricing is dynamic and increases as the exam date approaches, as clearly displayed on our website at the time of purchase. Payment is processed securely by Stripe, Inc. We do not store your payment card information. By completing a purchase, you authorize us to charge the displayed amount to your selected payment method. All sales are subject to applicable Canadian taxes where required by law.

6. Refund Policy

Your sole remedy for dissatisfaction with our Services is to discontinue use and, if within the 12-hour refund window from the time of purchase and provided content has not yet been accessed, request a refund in accordance with Section 6 of these Terms.

7. Device Access and Anti-Sharing Technology

Our Services employ technical measures to detect and prevent unauthorized account sharing, including device fingerprinting, concurrent session monitoring, IP address logging, and anomalous access pattern detection. Access is limited to a maximum of two registered devices per purchase. You consent to these monitoring activities as a condition of using our Services. If our systems detect access from more than the permitted number of devices, your account may be automatically restricted and flagged for review. We reserve the right to terminate accounts found to be sharing access without refund.

8. Intellectual Property

All content within our Services — including but not limited to study guides, practice questions, answer explanations, illustrations, text, graphics, and the overall structure and organization of the materials — is the original intellectual property of NPPE Preparation and is protected under the Copyright Act (Canada) and applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any of our content without our express prior written permission. Unauthorized reproduction or distribution of our materials is a violation of copyright law and these Terms, and will be prosecuted to the fullest extent permitted by law.

9. No Guarantee of Results

Our Services are designed to assist exam preparation and are based on our independent interpretation of publicly available information about the NPPE Blueprint and professional practice concepts. All content is provided for educational purposes only. We make no representation, warranty, or guarantee — express or implied — that our content is comprehensive, accurate, current, free from errors, or aligned with any specific version of the NPPE Blueprint. Exam candidates are solely responsible for verifying the accuracy of all content against authoritative sources before relying on it. We do not guarantee that use of our Services will result in passing the NPPE or any other examination. Examination outcomes depend on many factors entirely beyond our control, including but not limited to: individual study effort and preparation, prior knowledge, exam conditions, candidate performance on the day of the exam, examiner discretion, and changes to the examination blueprint or format. No refund, compensation, or credit will be provided on the basis of examination failure, regardless of circumstances. To the maximum extent permitted by applicable Alberta and Canadian law, NPPE Preparation and its owner expressly disclaim all liability for: (a) any inaccuracy, error, or omission in the content of our Services; (b) any failure by a candidate to pass the NPPE or any other examination; (c) any direct, indirect, incidental, special, or consequential loss or damage arising from reliance on our content, including but not limited to examination fees, re-examination fees, travel costs, lost employment opportunities, or any other costs or inconvenience associated with examination preparation or failure; and (d) any decision made in reliance on information provided through our Services. Your sole remedy for dissatisfaction with our Services is to discontinue use and, if within the refund window, request a refund in accordance with our Refund Policy.

10. Disclaimer of Warranties

Our Services are provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. We do not warrant that our Services will be uninterrupted, error-free, or free from viruses or other harmful components. Your use of our Services is at your sole risk.

11. Limitation of Liability

To the maximum extent permitted by applicable Alberta and Canadian law, NPPE Preparation and its owner shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or the cost of substitute services, arising from or related to your use of or inability to use our Services. Our total aggregate liability for any claim arising from or related to these Terms or our Services shall not exceed the amount you paid for access in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless NPPE Preparation and its owner from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way related to: (a) your use of our Services in violation of these Terms; (b) your violation of any applicable law or regulation; (c) your infringement of any third-party rights; or (d) any unauthorized access to our Services through your account.

13. Termination

We reserve the right to suspend or terminate your access to our Services at any time, with or without notice, for any violation of these Terms, including but not limited to: sharing account credentials, reproducing or distributing our content, providing false information during registration, or any conduct we determine to be harmful to our Services or other users. Termination for cause does not entitle you to a refund. We also reserve the right to discontinue our Services at any time upon reasonable notice, in which case we will provide a pro-rated refund for unused access time.

14. Privacy

Our collection and use of your personal information is governed by our Privacy Policy, available at https://www.nppepreparation.com/privacy, which is incorporated into these Terms by reference. By using our Services, you consent to our collection and use of your information as described in our Privacy Policy.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or our Services shall be resolved through good-faith negotiation between the parties. If negotiation fails, disputes shall be subject to the exclusive jurisdiction of the courts of the Province of Alberta. You waive any objection to the exercise of jurisdiction over you by such courts.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email at least 14 days before they take effect. Your continued use of our Services after the effective date of changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using our Services before the effective date.

17. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and NPPE Preparation with respect to your use of our Services and supersede all prior agreements, understandings, or representations.
